Machakos High Court today issued orders stopping the election of Kitui County Assembly Speaker scheduled for tomorrow after MCAs’ swearing-in.
This was after two candidates filed an urgent application for a court injunction after they were reportedly barred from submitting their nomination papers to the County Assembly clerk yesterday morning.
Jeremiah Mumo Kisangau and John Muneeni Makau sought the stoppage orders over what they termed as unlawful and irregular rejection of their nomination papers on assertions that they failed to beat the 9am deadline.
They accused the Clerk of conspiring with the incumbent Speaker George Ndotto, who is defending the seat for a second term, to have them locked out of the race apparently because they posed serious competition for Mr Ndotto.
Kisangau and Makau have maintained that they showed up with their papers at 8:50am and 8:40am respectively but were turned away on claim that they came way past the deadline.
The application, in which the Clerk and the County Assembly of Kitui were listed as the respondents, is set to be heard on Friday, September 8.
