Governor Kitui County, Dr. Julius Malombe has been served with a court order demanding him to appear before court on May 31.
According to the order Malombe risks being committed to a civil jail as he acted against court order issued on May 17 that barred him from sacking, suspending, harassing or intimidating applicant Dr. Evans Mumo.
The applicant Former Deputy Director for Health and Sanitation Evans Mumo on Monday May 23 filed contempt of court proceedings against the County Public Service Board, County Secretary and the County Government accusing the bodies of defying court order restraining them from taking any disciplinary measures against him.
The judge further suspended the sacking of Dr. Evans Mumo and directed Dr. Malombe, the County Acting Secretary Alex Kimanzi and probe committee Chairman Mwongela Munyoki to appear before court and explain why they shouldn’t be punished for their disobedience.
The applicant is among the five top official that were interdicted in December last year and consequently sacked on May 20 after a probe committee found them guilty of accusations against them.
The Governor said his decision to sack the officials was informed by the findings of 11-member investigation committee appointed in January to probe the conduct of the said officials.
The complaints varied from demanding for bribes, fraudulent alteration of records, collusion with service providers to make payments for undelivered goods, incompetence and inflating project costs.
The matter is before Justice Linnet Ndolo, who certified the matter as urgent and said that any disobedience or non-observance of the order given on 23rd May, 2016 would result in penal consequences to any person involved.
