A knock-back to Governor Malombe as a sacked top official maneuvers his way back into the system.
The court on Tuesday reinstated sacked Health Deputy Director for Kitui County Evans Mumo after his lawyer Erick Gumbo challenged the decision to sack him in court.
The applicant Deputy Director for Health and Sanitation Evans Mumo had earlier May 23 filed contempt of court proceedings against the County Public Service Board, County Secretary and the County Government accusing the bodies of defying court order restraining them from taking any disciplinary measures against him.
Dr. Malombe, Governor of Kitui County had on May 18 announced firing five top officials of the county including the applicant Evans Mumo.
The judge suspended the sacking of Dr. Evans Mumo and directed Dr. Malombe, the County Acting Secretary Alex Kimanzi and probe committee Chairman Mwongela Munyoki to appear before court.
The decision to sack Dr. Evans Mumo was challenged in court by his lawyer, Justice Linnet Ndolo of the Employment and Labour Relations Court on Tuesday ordered that Mumo be reinstated, paid his full salary and benefits.
His lawyer Erick Gumbo had been pursuing the case since January after Governor Julius Malombe suspended his client alongside other four top officials.
