The court has ruled in Governor Mutua’s favour, the Court of Appeal on Thursday stopped the prosecution of Machakos Governor Alfred Mutua over claims of illegal purchase of 16 county vehicles.
Machakos Governor Alfred Mutua who had earlier in September lost his bid to stop his prosecution left the court a happy man as orders of no arrest were issued.
Previously the High court had dismissed a petition Mutua had filed seeking to stop the director of public prosecution, the ethics and anti-corruption commission and the police from arresting charging and prosecuting him, saying his arguments lacks merits.
But on Thursday Oct 13 Justices GBM Kariuki, Festus Azangalala and Ole Kantai granted the order blocking the said entities from arresting Governor Mutua.
Dr Mutua is alleged to have flouted procurement laws when he purchased Subaru Outback vehicles for county executive committee members without following the due process
