Blow for Governor Ngilu as doctors win big in labour dispute

Employment and Labour Relations Judge Hon Lady Justice Monica Mbaru has granted the following several orders against the County Government of Kitui and Governor Charity Ngilu.

The Doctors at Kitui County will be paid their full dues which the county had stopped from July 2021.

Status quo to be maintained. The order means there will be no dismissal of doctors or suspending their postgraduate training or salaries pending the hearing.The judicial review and petition will be consolidated.

Further, the contempt application will be heard first.The respondents, including the County government, will file their replying affidavit within 7 days.Hearing of contempt application to be held on September 28, 2021.

The doctors were represented by Nairobi lawyer Henry Kurauka (pictured) who is the advocate for Kenya Medical Practitioners and Dentists Union (KMPDU) in the Petition.

Despite the stay orders by the court, the county government has gone ahead to conduct interviews to allegedly replace the doctors who are currently undertaking their postgraduate studies, completely disregarding the court orders.
